Growth Factory is a community for IT development. Growth Factory offers training courses, programs and events in various formats, as well as the opportunity to join IT clubs. 
If you have placed an order and paid for any of our services in full, it means that you have accepted the terms of this Offer.
The terms of the Offer apply to all Growth Factory services and are binding on all users.

Services 
Growth Factory offers the following types of services:

Participation in a closed club of IT entrepreneurs on the terms of the subscription you have chosen (hereinafter referred to as “Club Membership”). More information about the Club and the terms of membership can be found on the website.

Training courses and programs of various levels of complexity and scope according to the package you can choose on the website (the “Training Programs”). 

Please note that for some Training Programs, there are recommendations regarding work experience in the IT field or English language proficiency. Growth Factory reserves the right to assess your readiness to complete a particular Training Program.

Participation in events, such as workshops, seminars, conferences, etc. (hereinafter referred to as “Participation in Events”). A list of current events, if any, with a description and terms of participation will be available on the website (collectively, the “Services”).

You can learn more about each of the offered Services on the website of the selected Service.

Client account
Creating an account. In order to fully utilize some of the Growth Factory Services, including the ability to view the Training Program materials or participate in the Club, you must create an account and access your personal account. 

Password confidentiality. You set a password for access to your personal account and are responsible for maintaining its confidentiality.

Functionality. In your personal account, you can add information about yourself (mailbox address, name or nickname, links to Facebook, Telegram, LinkedIn, photo or avatar, your company name, etc.), check the status of your payments and view the materials of the Training Program you have purchased.

How to purchase a Club Membership
Terms and conditions. To join the Club, you must submit an application, pass a preliminary interview and pay the fee in accordance with the terms of the chosen subscription. Upon successful fulfillment of all the conditions, you will be granted access to the Club.

Your data. The information you provide when purchasing a Club Membership must be true. If you refuse to provide the required data, Growth Factory reserves the right to refuse to provide the Service.

Term of Membership. Growth Factory grants you access to the Club for the period you choose. After this period expires, the subscription is automatically renewed for the same period unless you cancel it before the previous subscription expires.

 

Automatic payment. If you have not canceled your subscription, the fee for further Participation in the Club will be charged automatically to the bank card you initially indicated during registration. If automatic debiting is not possible for some reason, access to the Club will be suspended until the subscription fee is paid.

Changes. Growth Factory reserves the right to change the subscription price for the Club Membership, which will be notified to you on the Club website or by e-mail, which you specified during the subscription process.

How to cancel the Club Membership
Right to cancel. You may cancel your Club Membership subscription at any time by notifying Growth Factory in writing.
Payment. If you cancel your Subscription, GFA will refund you for the current month and for the period of Membership you paid for but did not use after cancellation. 
Please note that Growth Factory will not be able to refund the cost of the Club Membership for the months prior to the month in which you canceled your subscription. 
Automatic Cancellation. Growth Factory may cancel your subscription without notice if you have violated the terms of the Offer or provided false information when applying for a Club Membership. 

Growth Factory will refund you for the period of the Membership you paid for but did not use due to the cancellation. Please note that Growth Factory will not be able to refund the cost of the Membership for the current month in which the subscription is canceled and for the months preceding the cancellation. 
 

How to purchase the Training Program or Participation in the Event
Terms of provision. To purchase a Training Program or Participation in the Event, you need to fill out an application on the website and pay the full price, unless payment by installments is available.
Payment by installments for Bulk Programs. For Training Programs, Growth Factory, at its sole discretion, may allow payment in installments. If you choose to pay in installments, the cost of the Training Program will increase by 20%.
Your data. The information you provide when purchasing a Training Program or Participation in the Event must be true. If you refuse to provide the required data, Growth Factory reserves the right to refuse to provide the Service.
Consent to data processing. By purchasing Participation in the Event, you agree to take photos and videos during the Event and allow Growth Factory to post these materials publicly.

Refund of payment for the Training Program 
Withdrawal from the Training Program. You may withdraw from the Training Program no later than 10 days before the start date. Growth Factory will refund the amount of payment received by the same means of electronic payment by which the payment was received and to the same account details (e-wallet) from which you made the payment.
Course cancellation. In case of cancellation of the Training Program: 
Growth Factory will refund you the actual amount paid, or 
You can choose any other Growth Factory Service of the same price as the one you paid for.
Growth Factory refunds the amount of payment received for the order by the same electronic payment method that was used to receive the funds and to the same account (e-wallet) details from which you made the payment.
Other grounds for return. You have the right to request a refund of the actual funds paid for the Training Program before the Training Program Completion Date.
The date of completion of the Training Program is the date of publication of the last lesson provided in the package you have chosen. 
Such requests are considered on a case-by-case basis. Growth Factory reserves the right to make a decision on the possibility of a refund at its sole discretion, taking into account specific circumstances. 

For some Training Programs, there are preliminary recommendations regarding the required level of knowledge or experience of participants. If you have purchased access to such a course without the experience specified in the description and the materials are not relevant to you, Growth Factory, by default, has no obligation to refund the cost and may, at its sole discretion, choose whether or not to issue a refund. 
Please note that after the Training Program Completion Date, Growth Factory has no further obligation to process requests for refunds.

Refund of payment for the Event
Withdrawal from the Event. You may cancel your participation in the Event before it starts. In this case, Growth Factory will refund the amount of payment received by the same means of electronic payment by which the payment was received and to the same account (e-wallet) details from which you made the payment.
Cancellation of the Event. In case of cancellation of the Event: 
Growth Factory will refund you the actual funds paid, or 
You can choose any other Growth Factory Service that is similar in price to the one you paid for.
Growth Factory refunds the amount of payment received for the order by the same electronic payment method that was used to receive the funds and the same account (e-wallet) details from which you made the payment.
Other grounds. In all other cases, Growth Factory will not be able to refund the funds you paid for Participation in the Event.

Intellectual property rights
The intellectual property rights to the materials posted on this website belong to Growth Factory.
You may use these materials solely for your own education. 
You may not sell, distribute for commercial purposes, or otherwise commercially exploit the materials on this site.
With the prior written consent of Growth Factory, you may provide access to certain materials you receive from Growth Factory to third parties, but only for their non-commercial personal use.
In the materials, Growth Factory may legally use intellectual property rights of third parties (photos, videos, etc.).

Privacy Policy 
Confidentiality. To provide the Services, the parties may agree to enter into a non-disclosure agreement (the “Agreement”). All information related to the Agreement, except for the fact of cooperation and the nature of the services provided, which is not publicly available and became known to the parties as a result of the conclusion or fulfillment of the terms of the Agreement, is confidential.
Customer data. Growth Factory may process the data you provide to the extent necessary for the proper provision of services. Growth Factory may create tables with customer data (name, company, nickname in Telegram, photo) and distribute them to other Growth Factory customers for communication purposes, etc. You are not allowed to share the link to the table with third parties. 
Disclosure is prohibited. The Parties undertake not to disclose or disclose Confidential Information to third parties and not to use it for any purpose not related to the fulfillment of obligations under this Offer and the Agreement.
Disclosure of Confidential Information. With your consent, Growth Factory may post your feedback about the Services on its website. 
With the consent of Growth Factory, you may transfer to third parties the materials and recommendations received from Growth Factory. 
You may post public feedback on the work of Growth Factory on the Internet and social media.

Links to other websites
The Growth Factory website may contain links to other websites. Please read the terms and conditions of use of each website you visit.
The payment window, its content that you will see when transferring funds, belongs to the payment system that we use to pay for services. 
Growth Factory is not responsible for the content and terms of use of any third-party websites or services.

Disclaimer of liability 
General disclaimers. Growth Factory makes every effort to ensure that the Services you receive meet your expectations. However, neither Growth Factory nor our representatives or partners are responsible for any loss or damage to you as a result:

Your use of the Growth Factory website or Services;

Actions of third parties on the Growth Factory website;

Improper use of the Services or access to the site by you;

Non-performance or improper performance of the Services by Growth Factory or third parties due to falsity, insufficiency or untimeliness of the information provided by you, as well as due to other violations of the terms of the Offer by you;

Failure to attend the Event for reasons beyond the control of Growth Factory;

Inconsistency of the Training Program with your expectations;

Unauthorized use of your personal data by third parties.

 

Result disclaimer. Growth Factory makes every effort to ensure that the Services you receive are of high quality and useful. However, we cannot guarantee a specific positive effect for your business as a result of using the Services or achieving a positive result in resolving each of your requests. 
Any recommendations and materials offered as part of the Services should be considered only as an additional source of knowledge that may be useful in solving your business problems.
We are not responsible for the final business result, as it is influenced by many factors. In particular, it largely depends on your efforts, diligence, time allocated and active participation in the learning process.
Warnings about the site. Please note that you use the site at your own risk. We cannot guarantee that the site will be uninterrupted or available at any particular time or location.

Applicable Law and Dispute Resolution 
This Offer shall be interpreted in accordance with the laws of Ukraine. Failure of Growth Factory to fulfill the terms of the Offer does not mean a waiver of them. The court's invalidation of certain provisions of the Offer does not entail the invalidity of other provisions.
Growth Factory suggests not to argue, and if a conflict arises, to resolve it peacefully through negotiations 🤝 
If the dispute cannot be resolved through negotiations, disputes are subject to consideration in court at the location of the Growth Factory.

Changes to the Offer
Growth Factory reserves the right to update the terms of the Offer. Growth Factory will do its best to notify you of the changes in advance.
Changes to the Offer become effective after Growth Factory posts them on this page.
